H.B. 379 Summary

• Establishes a new penalty provision in Chapter 194, Hawaii Revised Statutes, for any person who possesses, intentionally transports, harbors, or imports with intent to propagate, sell, or release any invasive species listed by the invasive species council (penalty amount to be determined).

• Amends the invasive species council's duties to require it to periodically update and maintain a list of all invasive species present in the State, rather than simply identify and record them.

• Mandates the invasive species council to adopt rules updating the invasive species list no later than June 30, 2012.

• Requires the Department of Land and Natural Resources to adopt administrative rules to implement the new penalty provision.
