Easement applies to state lands fronting private property identified as tax map key (2) 4-4-001:042

Seawall was originally constructed in 1965 to protect the parcel before Hale Kai Condominium development; environmental assessment completed and Office of Conservation and Coastal Lands issued finding of no significant impact

Board of Land and Natural Resources approved the Conservation District Use Application and easement issuance; lessee will pay fair market value as determined by independent appraisal

Fulfills legislative approval requirement under Hawaii Revised Statutes section 171-53 for leasing of state submerged lands
