Court must consider removing the alleged or potential perpetrator from the family home rather than placing the child in foster care when determining child placement under the Child Protective Act.

Child's family bears the burden of proving it is in the child's best interest to remove the child from the home instead of removing the perpetrator.

Purpose is to make paramount the safety and health of children in child protection proceedings.

Department of Human Services testified in support of the measure's intent.

Effective date amended to July 1, 2050, to allow for continued discussion.
