Requires the Department of Health to maintain early intervention services eligibility criteria and scope of covered services at minimum the same level in effect on January 1, 2012.

Ensures any child eligible for early intervention services as of January 1, 2012, remains eligible until having no deficit more than one standard deviation from population mean average or until aging out of the program.

Authorizes the Department of Health to establish a sliding fee scale for family cost participation, with no fees charged to families with household gross incomes at or below 300% of the federal poverty level.

Allows the Department of Health to require contracted service providers to offer early intervention services on a fee-for-service basis to individuals ineligible under federal IDEA at rates not exceeding the state's reimbursement rate.

Permits private health insurers to be charged for covered services and allows fees from family cost participation to be deposited into the early intervention special fund.
