Amends HRS §27-21.6 to clarify that counties regulate individual wastewater systems and private wastewater treatment works as a reassigned state function.

Permits counties to allow pre-existing individual wastewater treatment systems to continue operating on-site, except cesspools in special management areas, when the county determines it is fair and equitable.

Requires the pre-existing individual wastewater treatment system to pre-date the county-operated wastewater treatment system in order to qualify for continued use.

Mandates counties adopt rules or ordinances to implement these provisions no later than December 31, 2014.

Takes effect upon approval.
