Prohibits pharmacy benefits managers from using a patient's prescription claim information to market or advertise the services of a preferred pharmacy network owned by the pharmacy benefits manager.

Addresses concerns that patients are often unaware their information is being used for marketing purposes or that advertised pharmacy networks are affiliated with or owned by the pharmacy benefits manager.

Aims to prevent pharmacy benefits managers from unduly influencing patient behavior to drive business to their own subsidiary pharmacies.

Received support from the Office of Consumer Protection, Hawaii Food Industry Association, Walgreens, and Times Supermarkets; opposed by Ohana Health Plan, Express Scripts, Hawaii Medical Service Association, and CVS Caremark.

Made technical nonsubstantive amendments for clarity and consistency and referred to the Committee on Commerce and Consumer Protection for further consideration.
