State and county broadband permit applications are automatically approved if not acted upon within 60 days of submission (90 days for protective subzone conservation district applications, 120 days for other conservation district applications).

Applicants must receive written notice of incomplete applications within 10 business days, with 5 business days to submit complete application to remain eligible for automatic approval provisions.

Permits issued under this law must contain specific language identifying them as broadband-related permits under Hawaii Revised Statutes.

All applicants and public utilities must comply with applicable safety and engineering requirements for broadband infrastructure installation, improvement, and construction.

Utility pole weight loads are limited to maximum capacities established by the Federal Communications Commission and public utilities commission; the State and counties cannot require pole replacement if weight loads remain within safe capacity limits.
