S.C.R. No. 46 Summary

• Authorizes the Board of Land and Natural Resources to issue a term, non-exclusive easement on state submerged lands at Lanikai, Koolaupoko, Oahu (tax map key (1) 4-3-005) for seawall and revetment purposes.

• Covers approximately 1,268 square feet of encroachment area where a stone blanket shoreline protection structure was constructed around 1953 and expanded in 1968 with proper permits from the Department of Transportation, City and County of Honolulu, U.S. Army Corps of Engineers, and Department of Land and Natural Resources.

• The Board of Land and Natural Resources approved the easement request on January 13, 2012, from property owners James Hugh Duncan and Barbara-Jeann Duncan, with consideration payable as determined by an independent appraisal dated August 27, 2012.

• Fulfills statutory requirement under Hawaii Revised Statutes section 171-53 that leases of state submerged lands require prior approval by the Governor and prior authorization of the Legislature by Concurrent Resolution.
