Authorizes a 55-year non-exclusive easement on approximately 101 square feet of state-owned submerged land in Mokuleia, Waialua, Honolulu for Christine McAuliffe Fuss as successor trustee of the Priscilla Jane McAuliffe Living Trust (Tax Map Key 6-8-004-014).

Grants the right to use, maintain, repair, replace, and remove an existing seawall that encroaches on state submerged land and has done so since prior to 1964.

Requires a one-time payment to the state based on fair market rent as determined by independent or staff appraisal, subject to approval by the Board of Land and Natural Resources Chairperson.

Easement is contingent on the succeeding owner having no terminated lease, permit, easement, or other state land disposition within the previous five years due to noncompliance.

The Board of Land and Natural Resources approved this request on December 14, 2012, and determined the project is exempt from environmental assessment preparation under Hawaii Revised Statutes chapter 343.
