Authorizes a 55-year term, non-exclusive easement on state submerged lands in Kawailoa, Waialua, Oahu for Douglas and Kathleen Giannetti to maintain an approximately 110-foot seawall that encroaches on state property.

Requires a one-time payment to the state for fair market rent as determined by independent or staff appraisal, subject to review and approval by the Board of Land and Natural Resources Chairperson.

Easement is transferable to succeeding owners of the abutting property (tax map key (1) 6-1-003:024-0001), provided the new owner has not had a previous state land lease, permit, easement, or other disposition terminated within the past five years for noncompliance.

Board of Land and Natural Resources approved the request on January 11, 2013, and declared the project exempt from environmental assessment preparation under Hawaii Revised Statutes chapter 343.

Directs certified copies of the resolution to be transmitted to the Governor and Board of Land and Natural Resources Chairperson.
