Amends Hawaii Revised Statutes Section 291E-61.5(b) to redefine "habitual operator of a vehicle while under the influence of an intoxicant" to include two separate categories of offenders.

Creates new definition where a person qualifies as a habitual offender if convicted three or more times within ten years for operating a vehicle under the influence, or if convicted one or more times within ten years for habitually operating a vehicle under the influence.

Removes references to sections 291-4.4 and 291-7 from the definition of three-or-more-times convictions, limiting that category to violations of section 291-4, 291E-61, or 707-702.5.

Clarifies that convictions expunged by pardon, reversed, or set aside before the instant offense do not count as prior convictions for establishing habitual offender status.

Takes effect upon approval and does not affect rights, duties, or proceedings that began before the effective date.
