HI HB1371

Establishes mandatory minimum sentences for persons convicted of sexual assault offenses against minors age twelve or younger, with sentences applied only when not sentenced to extended terms under HRS 706-662.

Requires a mandatory minimum of six years, eight months imprisonment without parole or probation for conviction under HRS 707-730(1)(a), (d), or (e) (first-degree sexual assault).

Requires a mandatory minimum of three years, four months imprisonment without parole or probation for conviction under HRS 707-731(1)(a), (b), or (c) (second-degree sexual assault).

Requires a mandatory minimum of one year, eight months imprisonment without parole or probation for conviction under HRS 707-732(1)(a) (third-degree sexual assault).

Takes effect on July 1, 2013 and does not apply to proceedings begun before that date.
