Clarifies that operating a motor vehicle while using a mobile electronic device is prohibited when the device is held in hand for making/receiving non-emergency calls, texting, or receiving text messages, or to activate/deactivate/initiate device functions.

Exempts emergency responders, drivers using two-way radios for work duties with fleet vehicles or commercial licenses, amateur radio operators, and drivers at complete stops with engines off in safe locations from the mobile device prohibition.

Establishes a flat fine of $200 for violations; increases to $400 in school zones or construction areas; for drivers under 18, imposes $300 for second offense and $400 for third and subsequent offenses while under 18.

Requires all fines collected for violations to be deposited into the state highway fund.

Clarifies that violations are not classified as traffic infractions under section 291D-2 and defines key terms including "mobile electronic device," "operate," "use," and "texting."
