Requires the Department of Land and Natural Resources (DLNR) to adopt rules under Hawaii Revised Statutes Chapter 91 to regulate opihi harvesting by nonresidents from coastal areas and nearshore waters of Niihau.

Prohibits all persons from taking or harvesting opihi from Niihau's coastal and nearshore waters until the DLNR adopts such rules.

Establishes petty misdemeanor penalties for violations: $100 for first offense, $200 for second offense, and $500 for third or subsequent offenses.

Exempts persons exercising native Hawaiian gathering rights and traditional practices authorized by law or permitted by the DLNR under Hawaii Constitution Article XII, Section 7.

Requires the DLNR to submit status reports on rule adoption to the legislature no later than 20 days before each regular legislative session until rules are adopted.
