Limits Department of Human Services claims against estates of deceased medical assistance recipients to only those payments made for long-term care services.

Long-term care services include inpatient stays in nursing facilities, intermediate care facilities for individuals with intellectual disabilities, or other medical institutions.

Department may only file estate claims for long-term care costs if there is no surviving spouse or surviving child who is under twenty-one years of age, blind, or disabled.

Removes the previous age fifty-five requirement for recipients and clarifies that estate recovery applies only to long-term care services, not other medical assistance payments.

Effective upon approval.
