Requires restaurants and food establishments using expanded polystyrene foam containers to offer consumers compostable or reusable alternatives beginning January 1, 2016.

Allows restaurants to charge fees for compostable or reusable container options and requires visible signage informing consumers these alternatives are available.

Establishes penalty structure: written warning for initial violations, then $100 per violation for second and third violations, $200 for fourth and fifth violations, and $500 for sixth and subsequent violations.

Requires Department of Health to establish and maintain a publicly accessible list of suitable alternative packaging by January 1, 2015, updated periodically.

Effective July 1, 2014.
