HB 2241 - Production of Records

• Amends Hawaii Revised Statutes Chapter 806D to clarify service of process procedures when another state seeks production of records from Hawaii residents or businesses.

• Excludes government agencies from the definition of recipients who must comply with out-of-state process for record production.

• Requires out-of-state process to be based on a pending criminal investigation or prosecution and must specify the applicant's contact information, the authorizing statute, and relevant criminal statutes.

• Establishes three conditions for valid out-of-state process: the recipient must have conducted business or engaged in transactions or activities in the issuing state, the issuing state must have a reciprocal statute authorizing production of records by out-of-state persons or businesses, and the issuing state must allow service of process from other states.

• Updates the definition of "recipient" to include persons and businesses that have conducted business or engaged in transactions or activities occurring at least in part in Hawaii.
