HB2243 Summary

• Allows qualified entities (non-governmental organizations providing care services) to request and directly receive state and national fingerprint-based criminal history record checks on applicants, employees, and volunteers who work with children, vulnerable adults, or individuals with disabilities.

• Requires qualified entities to register with the Hawaii criminal justice data center, obtain signed waivers from individuals being checked, and comply with an attorney general-approved compliance agreement before submitting fingerprint requests.

• Grants qualified entities sole authority to determine whether criminal history records show fitness for employment or volunteer service, rather than requiring government agency approval.

• Requires qualified entities to notify individuals of their right to obtain copies of background screening reports and challenge the accuracy of information before final hiring or placement decisions are made.

• Effective July 2, 2014, and amends Hawaii Revised Statutes section 846-2.7 regarding criminal history record checks.
