Authorizes the Board of Land and Natural Resources to issue a term, nonexclusive easement for seawall purposes on state submerged lands at Mokuleia, Waialua, Oahu (tax map key (1) 6-8-010: seaward of 015).

Property owner Sutton Family Partners sought the easement because a rock seawall encroaches approximately 313 square feet onto state submerged lands due to shoreline erosion that reduced the buildable lot from 11,109 to 7,664 square feet.

The Board of Land and Natural Resources approved the nonexclusive easement request on May 24, 2013, and the Department of Land and Natural Resources approved issuance subject to payment of fair market value as determined by appraisal.

Legislative authorization is required under Hawaii Revised Statutes Section 171-53, which mandates prior approval by the Governor and prior authorization by the legislature through concurrent resolution to lease state submerged lands.
