Authorizes the Board of Land and Natural Resources to issue a term, non-exclusive easement covering state submerged lands at Tax Map Key (1) 5-3-006 (seaward of 021), Haleaha, Koolauloa, Oahu.

Easement permits maintenance and repair of an existing seawall and use, maintenance, and repair of existing improvements constructed on the submerged lands.

Seawall was established prior to December 23, 1958, according to survey records, and predates the Conservation District establishment in 1964.

Board of Land and Natural Resources previously approved a 55-year non-exclusive easement on July 25, 2003, under agenda item D-12 to resolve the encroachment with the former property owner.

Current property owners are Phillip T. Spencer and Lisa T. Spencer, who acquired the abutting property around September 2007.
