Request the State Procurement Office to conduct a study on the feasibility, necessary processes, and costs of requiring consideration of past performance as a factor in awarding public contracts, including low bid contracts.

Current law requires low bid contracts to be awarded to the lowest responsive bidder without mandatory consideration of a contractor's past performance history.

Past performance is currently only considered during evaluation of specific request for proposals, not routinely across all contract types.

Study should examine how other jurisdictions including the federal government, states, municipalities, and tribal governments successfully implement past performance requirements in low bid contracts.

State Procurement Office must submit findings, recommendations, and any proposed legislation to the Legislature no later than 20 days before the 2015 Regular Session convenes.
