SB 1141 Summary

• Requires all public agencies possessing medical, mental health, social, and juvenile records of defendants to provide those records to the court when the defendant is ordered to be examined under chapter 704, Hawaii Revised Statutes, notwithstanding any other state statute.

• Addresses delays in court-ordered forensic mental health evaluations caused by missing or untimely information from public agencies needed by examiners to complete evaluations.

• Intended to expedite forensic examinations of defendants, reduce length of stay at Hawaii State Hospital, and decrease overpopulation at the facility.

• Effective July 1, 2014.
