SB 2021 Summary

• Creates a new offense of "resisting arrest in the first degree" as a class C felony when a person intentionally removes or attempts to remove a firearm from a law enforcement officer during an arrest

• Reclassifies the existing resisting arrest offense as "resisting arrest in the second degree" and maintains it as a misdemeanor offense involving physical force or threats against an officer

• Aims to address dangerous situations where offenders attempt to disarm officers during arrest, which the legislature determined were not adequately covered by existing theft or escape statutes

• Takes effect on July 1, 2050
