Decriminalizes possession of one ounce or less of marijuana by establishing it as a civil violation rather than a criminal offense.

Imposes escalating civil fines: $100 for first violation, $250 for second violation, and $500 for third or subsequent violations.

Creates a new civil violation adjudication process in district courts with procedures for notices of violation, hearings, and appeals separate from criminal proceedings.

Allows medical marijuana patients registered with the department of health to assert medical use as an affirmative defense to civil marijuana possession violations.

Excludes one ounce or less of marijuana from the definition of "detrimental drug" in penal statutes related to drug paraphernalia and related offenses.
