SB2376 Summary

• Creates new misdemeanor offense of "indecent advertising" prohibiting nude or semi-nude images of massage therapists, relaxation therapists, or escorts in print, broadcast, or electronic advertisements that include specific keywords ("massage," "relaxation," "spa," "escort," or "body rubs").

• Prohibits references to intimate areas of persons advertised as massage therapists, relaxation therapists, or escorts in advertisements containing the specified keywords.

• Requires publishers and producers of advertising media to refuse publication of non-compliant advertisements for massage therapy, relaxation therapy, escort services, or related establishments.

• Provides rebuttable presumption of compliance for publishers who obtain written or electronic agreements from advertisers stating they will not advertise services in violation of state or federal law.

• Effective date is July 1, 2050.
