Prohibits retailers from imposing surcharges on consumers who elect to pay with a credit card instead of cash, check, or similar payment methods.

Allows retailers to offer discounts for cash, check, or non-credit card payments if the discount is offered to all prospective buyers.

Exempts transactions where retailers accept only credit cards for telephone or electronic orders from the surcharge prohibition.

Treats third-party credit card guarantee service charges as surcharges subject to the prohibition, even if charged separately or payable directly to the third party.

Does not apply to utility charges for credit or debit card payments that have been approved by the public utilities commission.
