S.B. 49 - Education; Statutory Revision

• Continues the work of Act 133 (2012) by amending or repealing various sections of Hawaii's public education law to resolve conflicting language, remove obsolete provisions, and improve efficiency.

• Adds three new definitions to education law: "attend" or "attendance" (physical presence after enrollment), "enroll" or "enrollment" (meeting requirements and being placed on school roll), and "license" (Hawaii teacher standards board certification).

• Removes Department of Education's authority to transfer appropriated funds and positions among programs and cost elements, limiting this flexibility to the University of Hawaii and Hawaii health systems corporation.

• Repeals Section 302A-603 (penalties for teaching without valid license), Section 302A-1001 (student bias protections), and Section 302A-1116 (authority to create temporary positions).

• Makes various technical amendments including changing "entered" to "attended" or "enrolled" throughout education statutes, removing smoking break provisions for employees, and eliminating experience requirements for vice-principals' certification.
