Authorizes the Board of Land and Natural Resources to issue a term, non-exclusive easement covering state submerged lands at Tax Map Key (1) 3-7-002 seaward of 040, Niu, Honolulu, Oahu.

Easement permits maintenance and repair of an existing seawall and steps, and use, maintenance, and repair of existing improvements constructed on the state submerged lands.

The Board of Land and Natural Resources approved a 55-year non-exclusive easement on March 1, 2004, to resolve encroachments by property owners Mitch and Barbara D'Olier.

Legislative authorization is required under Hawaii Revised Statutes section 171-53 for disposition of state submerged lands, with prior Governor approval also required.

A certified copy of the concurrent resolution shall be transmitted to the Chairperson of the Board of Land and Natural Resources upon passage.
