Requires counties to accept surrender of privately owned roads where no act of ownership has occurred for five years, with driving on the road not constituting an act of ownership.

Establishes that counties must accept surrendered roads without exercising discretion, unless the State notifies the county within 30 days that it will accept the road instead.

Allows occupants or owners of abutting land to notify counties of roads believed to qualify for surrender, with counties required to accept within six months unless they establish other proof of ownership.

Exempts the State and counties from requirements to perform construction, reconstruction, resurfacing, or rehabilitation on surrendered roads.

Grants the State and counties immunity from liability for personal injury, death, or property damage arising from use of surrendered roads, except where the State or county has performed maintenance work on the road.
