HB 173 Summary

• Repeals Chapter 261D of Hawaii Revised Statutes (Transportation use special fund) and removes it from the list of exempt special funds under Section 36-30.

• Abolishes three dormant funds administered by the Department of Transportation: the Amtrak trust account (established 1998), Hurricane Iniki insurance proceeds special fund (established 1997), and deposits-plans and specifications trust account (established 1988).

• Transfers all unencumbered balances from the abolished funds and repealed accounts to the general fund, with remaining balances lapsing to the general fund on June 30, 2015.

• Amends Section 261-5 to redirect certain airport revenues previously allocated to the transportation use special fund to the airport revenue fund instead.

• Effective July 1, 2050, with amendments to Section 36-30 taking effect immediately and not repealed when that section is reenacted on June 30, 2015 or December 31, 2015.
