• Establishes limited immunity from possession charges for controlled substances and drug paraphernalia when individuals seek medical assistance during drug or alcohol overdose emergencies.

• Provides protection for witnesses to overdoses who summon medical help if they reasonably believed the victim faced imminent threat to health or life and evidence was discovered only as a result of seeking assistance.

• Grants immunity to overdose victims themselves if evidence of possession was gained solely as a result of seeking medical assistance.

• Requires courts to consider seeking medical assistance as a mitigating factor in prosecutions related to controlled substances or alcohol where full immunity does not apply.

• Becomes effective July 1, 2050.
