Amends Hawaii Revised Statutes Section 329-125 to add new subsection (d) prohibiting employers from disciplining, suspending, discharging, or discriminating against employees solely for testing positive for marijuana metabolites if the employee is a qualified medical marijuana patient who strictly complied with state requirements.

Adds new Section 378 to Chapter 378, Hawaii Revised Statutes, establishing parallel employment protections for qualified medical marijuana patients against employer discrimination based on positive drug test results.

Clarifies that the employment protections do not authorize medical marijuana use in the workplace and do not override employer policies or agreements prohibiting employees from being under the influence of marijuana while working.

Applies only to substance abuse tests conducted in accordance with Sections 329B-5 or 329B-5.5 and only for employees who are registered qualifying patients under Part IX of Chapter 329.

Takes effect upon approval and does not affect rights, duties, penalties, or proceedings that began before the effective date.
