H.B. 864 - In Vitro Fertilization Insurance Coverage

• Expands in vitro fertilization (IVF) coverage requirements for individual and group health insurance plans by removing restrictions on marital status and spousal requirements for fertilization.

• Eliminates the five-year infertility history requirement and allows coverage when a physician determines other treatments are likely to be unsuccessful, instead of requiring prior unsuccessful treatment attempts.

• Redefines "infertility" as failure to achieve pregnancy after 12 months of unprotected intercourse or donor insemination, with earlier evaluation warranted after 6 months for women over 35 years old.

• Maintains existing requirements that IVF procedures be performed at facilities meeting American College of Obstetricians and Gynecologists guidelines or American Society for Reproductive Medicine standards.

• Provides exemptions for religious institutions and organizations whose beliefs conflict with covered procedures and excludes federal Medicaid program from coverage requirements.
