Department of Health is requested to provide written notification within a reasonable time to applicants if water quality certification applications are incomplete, including specific requirements needed to complete the application.

Department of Health is requested to deem an application complete if the applicant has not received written notice of incompleteness within a reasonable time after submission.

The resolution addresses delays in water quality certification processing under the Clean Water Act section 401, which currently can take up to three years and has created backlogs affecting projects including Honokohau Harbor.

Improved response times for water quality certification would allow state agencies to better budget for capital improvement projects and implement them more timely, saving money and improving public service.

Certified copies of the resolution are to be transmitted to the Director of Health and the United States Corps of Engineers, Pacific Ocean Division.
