Amends Hawaii Revised Statutes Section 378-3 to add a new exception to employment discrimination protections regarding supervisor harassment liability.

Exempts employers from liability for harassment by a supervisor unless the supervisor's agency status is proven to have been used to effect the harassment.

Modifies the existing exception in Section 378-3(11) by changing "or" to "or" and adding the new paragraph (12) regarding supervisor harassment liability.

Takes effect on January 7, 2059.

Does not affect rights, duties, penalties, or proceedings that began before the effective date.
