HI SB1162

Prohibits subdivision of agricultural parcels of 100 acres or greater if at least 50% has soil classified as overall productivity rating class A or B.

Exempts the Department of Agriculture, the Agribusiness Development Corporation, and bona fide commercial farmers from the subdivision prohibition.

Defines bona fide commercial farmer as someone with $35,000+ annual agricultural income for 3 of 5 prior years, or 51%+ gross income from agriculture for 2 prior years, or operation of 10+ acre agricultural enterprise for 2 prior years.

Requires verified statements from county officials that condominium projects on agricultural lands do not restrict agricultural uses, and prohibits condominium registration on qualifying large agricultural parcels except for exempted applicants.

Effective July 1, 2050.
