HI SB1302

Establishes a regulated statewide system of medical marijuana dispensaries and production centers licensed by the Department of Health to provide safe legal access to medical marijuana for qualifying patients.

Requires dispensaries to be Hawaii health care providers incorporated in-state for at least specified years, with at least specified percent ownership by Hawaii residents; prohibits employment of individuals convicted of felonies within specified years.

Sets minimum of specified dispensaries per county (with limits per county) and requires dispensaries to open for business within specified days of license approval; allows single dispensaries to operate in multiple counties if requirements are met.

Prohibits counties from enacting zoning ordinances that regulate or prohibit medical marijuana production centers or dispensaries, establishing state preemption over county zoning authority in this area.

Appropriates funds from general revenues to the medical marijuana registry and regulation special fund for fiscal years 2015-2016 and 2016-2017 to establish and regulate the dispensary system; requires Department of Health to develop repayment plan to general fund.
