SB 1334 Summary

• Authorizes law enforcement officers to tow motor vehicles at the owner's expense when the operator is arrested or cited for operating under the influence, habitual DUI, driving with suspended/revoked license, or driving after consuming alcohol.

• Prohibits towing if the vehicle is parked on private residential property where the owner resides or has property owner consent, or if a licensed driver is present and willing to operate the vehicle.

• Prohibits towing if the vehicle is legally parked in a safe location with low theft/vandalism risk, or if the vehicle is engaged in community caretaking activities unrelated to criminal investigation.

• Defines "community caretaking" as consensual police-citizen encounters unrelated to investigation or detection of criminal activity.

• Eliminates police department responsibility for protecting vehicles left on public or private property after an operator's arrest for alcohol-related violations.
