HI SB140

Requires all units of government and political subdivisions in Hawaii to exercise reasonable care in maintaining government records that are required to be open for public inspection under chapter 92F.

Mandates that agencies issue instructions and guidelines to implement this requirement and ensure all employees and officers responsible for records are informed of the duty.

Creates a rebuttable presumption that reasonable care was exercised if an agency adheres to a duly adopted records retention and destruction plan.

Applies this presumption in defending causes of action related to records maintenance.

Takes effect on July 1, 2030.
