Amends Hawaii Revised Statutes Section 291E-61.5(b) to redefine "habitual operator of a vehicle while under the influence of an intoxicant"

Creates a new category where a person is deemed a habitual offender if convicted one or more times within ten years for habitually operating a vehicle under the influence, in addition to the existing requirement of three or more DUI convictions within ten years

Clarifies that prior convictions that have been expunged by pardon, reversed, or set aside do not count toward habitual offender status

Applies to violations of current law and comparable offenses under prior statutes (sections 291-4, 291-4.4, 291-7, 291E-61, and 707-702.5), as well as adjudications of minors for comparable violations

Takes effect upon approval with no retroactive application to rights, duties, penalties, and proceedings that began before the effective date
