SB 305 Summary

• Prohibits the use of any tobacco product or e-cigarette by any person on the premises of all Hawaii health systems corporation facilities statewide, including indoor and outdoor areas and parking lots.

• Requires the corporation to provide tobacco cessation programs for public employees at its health facilities who wish to participate, with costs subject to collective bargaining.

• Mandates the corporation educate health facility personnel, contractors, patients, and visitors about the prohibitions and display prominent signage at all entrances and conspicuous outdoor locations stating "tobacco and e-cigarette use is prohibited."

• Defines "e-cigarette" as any electronic oral device providing vapor of nicotine or other substances for inhalation, excluding FDA-approved medical treatments, and "tobacco product" as any substance containing tobacco leaf or biologically active nicotine, excluding FDA-approved cessation products.

• Exempts the prohibition from collective bargaining under state labor law and prohibits application of chapter 328J regulations.
