HI SB692

Adds a new Class C felony offense for any person who causes physical harm to another person through the negligent application of a pesticide, with penalties of up to $10,000 in fines or up to 5 years imprisonment, or both.

Reorganizes existing criminal penalty provisions in Hawaii Revised Statutes Section 149A-41(c) by renumbering subsections to accommodate the new felony provision.

Maintains existing misdemeanor penalties for registrants, commercial applicators, wholesalers, dealers, retailers, and other distributors who knowingly violate pesticide laws (up to $25,000 fine or 1 year imprisonment).

Maintains existing misdemeanor penalties for private applicators and other persons who knowingly violate pesticide laws (up to $1,000 fine or 1 year imprisonment).

Takes effect upon approval and does not affect rights, duties, penalties, or proceedings that occurred before the bill's effective date.
