HI SB812

Authorizes the Department of Health to establish a behavior support review committee to conduct multidisciplinary reviews of restraint or seclusion use for persons with developmental or intellectual disabilities.

Requires providers and state/county agencies to disclose to the department circumstances of restraint or seclusion upon written request by the director to allow for review and risk reduction.

Establishes that information and records from reviews remain confidential and may only be disclosed as necessary to carry out review purposes, with statistical data without identifying information becoming public record.

Prohibits information obtained through multidisciplinary reviews from being subpoenaed, discovered, or introduced in civil or criminal proceedings unless required by court order.

Provides civil and criminal immunity for department staff and behavior support review committee members who participate in reviews in good faith and with reasonable effort to obtain facts, and protects those providing required information from liability.
