Adds new provision to sexual assault in the second degree (HRS 707-731) making it a crime for a person acting in a professional capacity to instruct, advise, or supervise a minor aged 16 or older to engage in sexual penetration with that minor, provided the person is at least five years older and not legally married to the minor.

Adds new provision to sexual assault in the fourth degree (HRS 707-733) making it a crime for a person acting in a professional capacity to instruct, advise, or supervise a minor aged 16 or older to engage in or cause sexual contact with that minor, with the same age difference and non-marriage requirements.

Establishes exceptions for both new provisions regarding licensed practitioners under chapters 453 or 455 (professional licensing chapters) and for lawful law enforcement searches.

Does not apply retroactively to rights, duties, penalties, or proceedings that occurred before the effective date.

Takes effect on July 1, 2016.
