Levies a 5% surcharge on all sales of activities by activity desks, with proceeds remitted quarterly to the director of commerce and consumer affairs.

Deposits surcharge proceeds into the Conservation and Resource Enforcement Special Fund established under section 199-1.5.

Requires activity desks to maintain an activity surcharge special subaccount in a federally insured financial institution located in Hawaii to hold collected surcharges.

Amends section 468M-9 to clarify that activity desk trust account deposits are not required for sums subject to the activity surcharge under the new sections.

Takes effect on July 1, 2020.
