Permits beneficiaries whose nearest in-network retail pharmacy is 10 or more miles away to use any retail community pharmacy within 10 miles of their residence without penalty.

Prohibits plans from imposing different copayments, fees, quantity limits, refill restrictions, or administrative requirements on non-network pharmacy use compared to in-network or mail-order pharmacies.

Requires non-network retail pharmacies to be reimbursed $15 dispensing fee plus product cost at the higher of applicable reimbursement rates.

Increases maximum fines for pharmacy benefit manager violations from $10,000 to include violations of the new geographic exemption provision, with authority for corrective action and restitution.

Takes effect July 1, 2016.
