Prohibits any person from knowingly or intentionally selling or offering to sell aquatic life acquired through spearfishing in Hawaii state waters.

Exempts customary and traditional rights for subsistence, cultural, or religious purposes, including native Hawaiian gathering rights protected by the Hawaii state constitution.

Exempts individuals who spearfish for personal use such as human consumption or bait with no intention to sell.

Establishes penalties including misdemeanor charges with fines of $500 for first offense, $2,000 for second offense, and $10,000 for third or subsequent offense.

Authorizes additional penalties including administrative fines up to $1,000 per specimen sold, seizure and forfeiture of aquatic life specimens and fishing equipment, and recovery of administrative and attorney's fees.
