HI HB2084

Prohibits all health insurers in Hawaii, including accident and health insurers, hospital and medical service insurers, health maintenance organizations, and state health benefits plans, from discriminating based on actual gender identity or perceived gender identity.

Defines discrimination to include denying, canceling, limiting, or refusing to issue policies; charging higher premiums; designating gender identity as a preexisting condition; and denying coverage for gender transition-related services or sex-specific health services.

Requires medical necessity determinations for covered services to be consistent with other covered services and applies standard copayment, deductible, and coinsurance provisions to gender identity-related coverage.

Establishes definitions for "actual gender identity," "perceived gender identity," "gender transition," and "transgender person" for purposes of the non-discrimination requirements.

Takes effect upon approval, with non-discrimination provisions applying to all policies issued or renewed on or after January 1, 2017, and state health benefits plans modified on or after that date.
