Director of Public Safety may release misdemeanants from community correctional centers on recognizance when capacity is reached, with the director's order superseding court orders.

Persons ineligible for release include those denied bail or with bail over $5,000, those charged with serious crimes, those with domestic abuse convictions, and those with prior convictions for crimes involving injury or threat to others.

Released misdemeanants must comply with conditions in HI §804-7.4 and any additional conditions imposed by the director or contained in superseded court orders; violations are handled per §804-7.2 and §804-7.3.

Director of Public Safety must report to the legislature before 2018, 2019, and 2020 sessions on release numbers, selection criteria, post-release offenses, law enforcement interactions, and other relevant data.

Act takes effect July 1, 2016 and repeals July 1, 2020; applies only to persons charged with offenses under §706-663 on or after the effective date.
