H.B. 768 Summary

• Creates two new sections (356D-A and 356D-B) authorizing the Hawaii public housing authority to sell, donate, or otherwise dispose of property abandoned, seized, or remaining upon eviction at federal, state, and elderly housing projects.

• Requires certified mail notice at least 5 days before disposition for items valued at $500 or more per item, and mandates countywide public notice at least 10 days before disposition; items under $500 can be disposed of at the authority's discretion without notice requirements.

• Mandates public auction by oral offers for property valued at $500 or more per item; property may be repossessed by rightful owners upon proof of entitlement and payment of all unpaid rent, debts, charges, fines, and expenses.

• Directs proceeds from sales to first offset unpaid rent, debts, charges, fines, and all disposal expenses; any remaining balance is held in a special fund and may be claimed by the former owner within 6 months, after which it becomes a government realization.

• Repeals sections 356D-56.1, 356D-57, and 356D-58 regarding disposition of abandoned property and replaces them with the new comprehensive framework; effective July 1, 2050.
